General Terms and Conditions of Sale (GTC) for online purchases on the website www.doria1905.com

("Doria 1905") invites users to read these General Terms and Conditions of Sale ("GTC") that govern the purchase of products and the management of orders placed on the site.

Only "Doria 1905 products" are offered for sale on www.doria1905.com.

Conclusion of contract and delivery of products

1.1 Every order placed on www.doria1905.com implies the conclusion of a contract of sale in Italian. When the order is for a Doria 1905 product, only one contract is concluded between the purchaser and Neo.B-Lab, the company behind the Doria 1905 brand.

1.2 By clicking on the "Buy now" button, the customer places a binding order for the items contained in the virtual shopping cart. Once the order has been placed, Doria 1905 will send the customer an e-mail confirming the order within 1 hour. The contract of sale is concluded between Doria 1905 and the customer when the latter receives confirmation of the order. If the customer does not receive any order confirmation within the period indicated in this art. 1.2., the order will be considered rejected by Doria 1905 and therefore ineffective. Orders for which the customer has opted for payment in advance will be shipped as soon as Doria 1905 receives full payment of the purchase price and any shipping costs. Doria 1905 invites, therefore, the customer to pay the price as soon as it receives confirmation of the order and in any case within 7 days.

1.3 The Purchaser gives its prior consent to the assignment of claims for payment of the purchase price to third parties, in particular to Neo.B-Lab.

1.4 If the products ordered are not available for reasons beyond Doria 1905's control, Doria 1905 must promptly notify the customer. In this case, there will be no obligation for Doria 1905 to deliver the ordered goods, except in the case where Doria 1905 has assumed the risk of supply in relation to the products that form the order in question.

In any case, if the products ordered are not available, Doria 1905 will reimburse the customer, without any delay, for any sum already paid.

1.5 Doria 1905 is not responsible for the search and retrieval of unavailable products from other sources. If the delivery time is expressed in working days, all days between Monday and Friday inclusive are considered working days, with the express exclusion of any public holidays.

2.Prices, shipping costs and express delivery

2.1 The customer is obliged to pay the price published on the product page when placing the order. The price indicated is final and includes VAT.

2.2 Shipping costs are borne by Doria 1905.

 

3.Payment

3.1 Doria 1905 accepts various methods of payment including, but not limited to: credit card, bank transfer and Paypal. Doria 1905 reserves the right to refuse certain payment methods and to request different payment methods for certain orders. Please note that Doria 1905 only accepts payments from bank accounts within the European Union (EU) and that the customer is responsible for any costs associated with the transaction.

3.2 In the case of a purchase made by credit card, the charge shall be made at the time of dispatch of the order.

3.3 The Purchaser agrees to receive invoices and credits exclusively in electronic form.

4.Use of promotional vouchers

4.1 Promotional vouchers cannot be purchased, are offered by Doria 1905 as part of promotional campaigns and can be used for a limited period of validity.

4.2 Promotion vouchers may only be used once in connection with a single order within the specified period of validity. Certain products may not be eligible for promotional vouchers. Promotional vouchers cannot be used to purchase gift vouchers. The use of a promotional voucher may be subject to a minimum spend.

4.3 The value of the products purchased must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the products ordered, the difference can be paid by any of the accepted methods of payment set out in Article 3 above. Promotion vouchers are not redeemable for cash and no interest is payable on the credit. Promotional vouchers will not be refunded if the purchaser decides to return part or all of the products ordered.

4.4 Promotional vouchers can only be used if the order is finalised, cannot be used retroactively and cannot be transferred to third parties. Unless otherwise provided by Doria 1905, it is not possible to combine several promotional vouchers for the same order.

4.5 If, during the course of the order, the customer has used a promotional voucher and if the total value of the order - due to the withdrawal of the customer - is lower than the value of the promotional voucher, Doria 1905 reserves the right to invoice the original price of the goods that remain in the possession of the customer.

5.Use of gift vouchers

5.1 Gift vouchers can only be purchased, and can only be used, for the purchase of Products and not for the purchase of further gift vouchers. If the value of the gift vouchers is not sufficient to cover the value of the products ordered, the difference can be paid by any of the accepted methods of payment.

5.2 Gift cards may only be redeemed prior to placing an order, are not redeemable for cash and do not bear interest. If you wish to redeem a gift card, transfer the credit to your account and check the balance, please visit the "My Account" section at www.doria1905.com.

6. Right of withdrawal 

The customer has the right to withdraw from any order concerning Doria 1905 Products, without giving any reason and with any declaration, as long as it is explicit, delivered to Doria 1905. The right of withdrawal is, however, excluded in relation to sealed Doria 1905 products that are not suitable for return for reasons of hygiene or health protection.

If the customer intends to return the purchased products, he can use the return label received with the order or he can print a new one through his personal page accessible from the Doria 1905 website. If the customer does not have access to a printer, if he/she has problems downloading the return label or if he/she needs a new label, he/she can contact Customer Service by email or by calling the number on the Doria 1905 website.

6.1 Information on the right of withdrawal (ex art. 49, paragraph 1, letter (h) of Legislative Decree no. 206/2005 "Consumer Code")

The customer has the right to withdraw from the contract, without stating any reasons, within 14 days. The withdrawal period shall expire after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract relating to several goods ordered by the customer in one order and delivered separately, the 14-day period shall run from the day on which the customer or a third party other than the carrier designated by the customer acquires physical possession of the last good.

You may, but are not obliged to, use the standard withdrawal form available for downloading here or use the standard text indicated in point 6.3. If the customer decides not to use the enclosed standard withdrawal form, he must submit any other explicit statement of his decision to withdraw from the contract.

It is also possible to complete and send the standard withdrawal form or any other explicit declaration of withdrawal electronically via the Doria 1905 website. In this case, Doria 1905 will promptly send an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by e-mail). The deadline for withdrawal is deemed to have been met if the customer sends his declaration before the expiry of the 14-day period starting on the day on which the customer or a third party other than the carrier and designated by the customer acquires physical possession of the last item ordered. In the case of a contract covering several goods ordered by the customer in one order and delivered separately, the 14-day period begins on the day on which the customer or a third party other than the carrier designated by the customer acquires physical possession of the last good.

6.2 Effects of withdrawal

Following the withdrawal from this contract, Doria 1905 will refund all payments made by the buyer, including delivery costs (except for any additional costs arising from the choice of a type of delivery other than the standard one offered by Doria 1905), without undue delay and in any case no later than 14 days from the day on which Doria 1905 is informed by the customer of the decision to exercise the right of withdrawal. These refunds will be made using the same payment instrument used by the customer at the time of purchase, unless otherwise agreed.

Where the buyer has chosen, as a method of payment at the time of purchase, payment in cash on delivery, must indicate, as part of the online form of withdrawal, the bank account to which it intends to receive the credit of the price. In case of failure to indicate the bank details or in case of incorrect bank details, Doria 1905 will automatically credit the amount of the price on the account of the customer who can use it for future purchases or request its subsequent restitution by communicating to Doria 1905 its bank details by responding to the email that Doria 1905 will send to communicate the crediting of the account.

In any case, the customer will not incur any costs as a result of this refund. The refund may be suspended until receipt by Doria 1905 of the products being returned or until the customer demonstrates that these goods have been shipped, if earlier.

The customer is obliged to return or deliver the products without undue delay and in any event within 14 days of the day on which he communicated his wish to withdraw from the purchase agreement.

Products must be returned

- properly packaged in their original packaging, not damaged, damaged or soiled and equipped with any accessories, instructions for use and documentation. In case of loss of the original packaging, the Customer will have to replace it at his own expense in order to be able to return the Doria 1905 Products;

- with the transport document (in the original packaging), so that Doria 1905 can identify the customer (Order number, name, surname and address);

- with no obvious signs of use other than those compatible with normal testing of the article (they must not bear any traces of prolonged use or of use exceeding the time necessary for testing and must not be in a state such that they cannot be resold).

If the returned product does not comply with the requirements of the preceding paragraph, or if the exception to the right of withdrawal indicated in paragraph 6 applies to sealed products, the withdrawal shall not be effective.

The cost of returning the goods will be borne by Doria 1905 as long as the customer uses the return documents provided by Doria 1905 and ships the goods from the country to which they were delivered. Otherwise, the costs of the return will be borne by the customer. The customer is responsible for any decrease in the value of the goods resulting from handling the goods in a manner different from that necessary to establish the nature, characteristics and functioning of the products.

9. Refunds

Invoices will only be issued in electronic format.

9.1 Refunds are credited directly to the account or payment instrument used at the time of purchase. For payments made by bank transfer, the refund will be made to the account used for the payment. For payments made by Paypal or credit card, the refund will be made to the Paypal account or credit card. For payments made by cash on delivery, the refund will be made, alternatively, to the account that the customer will indicate by filling out the standard withdrawal form or in the communication that will send to Doria 1905 to communicate the withdrawal. It is understood that, in the event that the customer does not indicate a bank account for the credit during the exercise of the right of withdrawal or indicates an incorrect bank account, Doria 1905 will automatically credit the customer's account so that he can use this amount for subsequent purchases or request a subsequent refund by communicating to Doria 1905 his bank details by responding to the email with which Doria 1905 will communicate the crediting of the amount to the account. If a gift voucher has been used for the order, Doria 1905 will re-credit the relative amount to the customer's account.

11. Warranty for defects and additional information

11.1 Purchases made on Doria 1905 are subject to the rules of the Consumer Code in terms of warranty for defects and deformities of the products. The customer will therefore be entitled to the rights referred to in Article 130 of the Consumer Code and these rights must be exercised within the terms of Article 132 of the Consumer Code.

11.2 These GTCs can be viewed at www.zalando.it and can be saved using the relevant browser command (usually File -> Save As).

11.3 You can save the order details and download the GTCs by using the relevant browser command to save the order summary that appears on the last screen of the purchase process, or by waiting to receive the automatic order confirmation message that Doria 1905 sends by email after you complete your order. This confirmation message includes the details of the order and the Doria 1905 General Terms and Conditions of Sale, and can be easily printed or saved using the functions provided by e-mail programs.

12. Applicable law

12.1 These General Terms and Conditions of Sale and the contracts of sale are governed by Italian law (and in particular by the Italian Consumer Code - which in Articles 46 to 67 governs distance contracts - and by Legislative Decree 70 of 09/04/2003 on electronic commerce) and must be interpreted in the light of this.

12.2 For any disputes that may arise in connection with the GTC and/or the sales contracts, the customers may activate an out-of-court dispute resolution procedure in accordance with the requirements of Art. 141 et seq. of the Consumer Code.

12.3 The customer is also entitled to use the online dispute resolution procedure available at http://ec.europa.eu/consumers/odr/.
