General Conditions of Sale (GCS) for purchases made online on the site www.doria1905.com

("Doria 1905") Invites users to read these General Conditions of Sale ("CGV") Which regulate the purchase of products and the management of orders placed on the site.

On the website www.doria1905.com only “Products Doria 1905” are offered for sale.

1. Conclusion of the contract and delivery of the products

1.1 Any order placed on www.doria1905.com implies the conclusion of a sales contract in Italian. When the order relates to a Doria 1905 product, a single contract is concluded between the buyer and Neo.B-Lab, the company in charge of the Doria 1905 brand.

1.2 By clicking on the "Buy now”The customer places a binding order for the items contained in the virtual shopping cart. Once the order has been sent, Doria 1905 will send the customer an e-mail confirming the order within 1 hour. The sales contract is concluded between Doria 1905 and the customer when the latter receives the order confirmation. If the customer does not receive any confirmation of the order within the term indicated in this art. 1.2., The relative order must be understood as rejected by Doria 1905 and, therefore, ineffective. Orders in relation to which the customer has opted for advance payment will be shipped as soon as Doria 1905 receives the total payment of the purchase price and any shipping costs. Doria 1905 therefore invites the customer to pay the price as soon as the order is confirmed and in any case within the following 7 days.

1.3 The buyer gives his prior consent to the transfer to third parties, in particular to Neo.B-Lab, of the credits for the payment of the purchase price.

1.4 Where the products covered by the order are not available for reasons independent of Doria 1905's conduct, the latter must promptly notify the customer. In this case, there will be no obligation for Doria 1905 to deliver the ordered goods, except in the case in which Doria 1905 has assumed the supply risk in relation to the products that make up the order in question.

In any case, if the ordered products are not available, Doria 1905 will refund, in favor of the customer, any sum already paid.

1.5 Doria 1905 does not assume the responsibility of having to search and find unavailable products from other sources. If the delivery time is expressed in working days, it is understood as such all those included between Monday and Friday, with the express exclusion of any holidays.

2.Prices, shipping costs and express delivery

2.1 The customer is required to pay the price published on the product page at the time the order is sent. The indicated price is final and inclusive of VAT.

2.2 Shipping costs are borne by Doria 1905.

 

3. Payment

3.1 Doria 1905 accepts various payment methods including, for indicative purposes: by credit card, by bank transfer and Paypal. Doria 1905 reserves the right to refuse some payment methods and to request different payment methods for certain orders. Note that Doria 1905 only accepts payments from bank accounts within the European Union (EU) and that the customer is responsible for any costs associated with the transaction.

3.2 In the event of a purchase made with a credit card, the charge will be made when the order is shipped.

3.3 The buyer agrees to receive invoices and credits exclusively in electronic format.

4.Use of promotional vouchers

4.1 Promotional vouchers cannot be purchased, they are offered by Doria 1905 as part of promotional campaigns and can be used for a limited period of validity.

4.2 Promotional vouchers can be used only once in relation to a single order, within the specified validity period. It is possible that for the purchase of some products the possibility of using promotional vouchers is excluded. Promotional vouchers cannot be used for the purchase of gift vouchers. The use of a promotional voucher may be subject to a minimum amount of expenditure.

4.3 The value of the purchased products must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the products ordered, the difference can be paid through any of the accepted payment methods referred to in Article 3 above. Promotional vouchers are not redeemable in cash and do not accrue interest on the credit represented by them. Promotional vouchers will not be refunded if the buyer decides to partially or completely return the ordered products.

4.4 Promotional vouchers can only be used if the order is finalized, cannot be used retroactively and cannot be transferred to third parties. Unless otherwise provided by Doria 1905, it is not possible to combine several promotional vouchers for the same order.

4.5 If during the order the customer used a promotional voucher and if the total value of the order - due to the customer's withdrawal - should be lower than the value of the promotional voucher, Doria 1905 reserves the right from now on to invoice the original price of the goods that remain in the possession of the customer.

5.Use of gift vouchers

5.1 Gift vouchers can be purchased, and can only be used for the purchase of Products and not for the purchase of additional gift vouchers. If the value of the gift vouchers is not sufficient to cover the value of the products ordered, the difference can be paid through any of the accepted payment methods.

5.2 The gift cards can be used only before placing the order, they are not refundable in cash and the credit represented by them does not accrue interest. 6. Right of withdrawal 

The customer has the right to withdraw from any order relating to Doria 1905 Products, without giving any reasons and with any declaration, as long as explicit, delivered to Doria 1905. The right of withdrawal is however excluded in relation to sealed Doria 1905 Products that are not they are ready to be returned for hygienic reasons or related to health protection.

If the customer intends to return the purchased products, he can use the return label received with the order or he can print a new one through his personal page accessible from the Doria 1905 website. If the customer does not have access to a printer, if if you have problems downloading the return label or if you need a new label, you can contact Customer Service by email or by calling the number on the Doria 1905 website.

6.1 Information regarding the right of withdrawal (pursuant to Article 49, paragraph 1, letter (h) of Legislative Decree no. 206/2005 "Consumer Code")

The customer has the right to withdraw from the contract, without giving any reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the term of 14 days starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.

To this end it is possible, but not mandatory, to use the downloadable standard withdrawal form here or use the standard text indicated in point 6.3. Where the customer decides not to use the attached standard withdrawal form, he must submit any other explicit declaration of his decision to withdraw from the contract.

It is also possible to electronically fill in and send the standard withdrawal form or any other explicit declaration to this effect through the Doria 1905 website. In this case, Doria 1905 will immediately send a confirmation of receipt of the withdrawal on a durable medium (for example via e-mail). The deadline set for the withdrawal is considered respected if the customer submits his declaration before the expiry of the 14-day deadline starting from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. 6.2 Effects of withdrawal

Following the withdrawal from this contract, Doria 1905 will reimburse all payments made by the buyer, including delivery costs (with the exception of any additional costs resulting from the choice of a type of delivery other than the standard one offered by Doria 1905), without undue delay and in any case no later than 14 days from the day on which Doria 1905 is informed by the customer of the decision to exercise the right of withdrawal. These refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise agreed.

Where the purchaser has chosen cash on delivery as the payment method during the purchase, he must indicate, in the online withdrawal form, the current account on which he intends to receive the price credit. In case of failure to indicate the bank details or in case of incorrect bank details, Doria 1905 will automatically credit the amount of the price on the customer's account, who can use it for subsequent purchases or request the subsequent return by communicating their coordinates to Doria 1905 bank by replying to the email that Doria 1905 will send to communicate that the account has been credited.

In any case, the customer will not have to incur any costs as a consequence of this refund. The refund may be suspended until Doria 1905 receives the returned products or until the customer demonstrates that such goods have been shipped, if earlier.

The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the sales contract.

The Products must be returned

- properly packaged in their original packaging, not damaged, damaged or soiled and equipped with all accessories, instructions for use and documentation. In case of loss of the original packaging, the Customer must, at his own expense, replace it in order to be able to return the Doria 1905 Products;

- with the transport document (present in the original packaging), in order to allow Doria 1905 to identify the customer (order number, name, surname and address);

- without obvious signs of use, other than those compatible with carrying out a normal test of the article (they must not bear traces of prolonged use or in any case exceeding the time necessary for a test and must not be in such a state as not to allow resale).

If the returned product does not comply with the provisions of the previous paragraph, or the exception to the right of withdrawal indicated in paragraph 6 in relation to sealed products is made, the withdrawal will not be effective.

The costs of returning the goods are borne by Doria 1905 as long as the customer uses the return documents provided by Doria 1905 and sends the goods from the country in which the delivery took place. Otherwise, the costs of the return will be borne by the customer. The customer is responsible for any decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products themselves.

9. Refunds

Invoices will be issued exclusively in electronic format.

9.1 Refunds are credited directly to the account or payment instrument used at the time of purchase. For payments made by bank transfer, the refund will be made to the account used for the payment. For payments made via Paypal or credit card, the refund will be made to the Paypal account or credit card. For payments made by cash on delivery, the refund will be made, alternatively, to the current account that the customer will indicate by filling out the standard withdrawal form or in the communication that he will send to Doria 1905 to communicate the withdrawal. It is understood that, in the event that the customer does not indicate a current account for crediting during the exercise of the right of withdrawal or indicates an incorrect current account, Doria 1905 will automatically proceed to credit the customer's account in order to use this amount. for subsequent purchases or ask for a subsequent return by communicating your bank details to Doria 1905 by replying to the email with which Doria 1905 will notify him of the crediting of the amount on the account. If a gift voucher was used for the order, Doria 1905 will re-credit the relative sum on the customer's account.

11. Warranty for defects and non-conformities of the products and additional information

11.1 Purchases made on Doria 1905 are subject to the rules of the Consumer Code regarding the guarantee for product defects and discrepancies. The customer will therefore be granted the rights referred to in art. 130 of the Consumer Code and these rights must be exercised within the terms set out in art. 132 of the same Consumer Code.

11.2 These GCS can be consulted on the site www.zalando.it and can be saved using the relative browser command (usually, File -> Save As).

11.3 It is possible to archive the order details and download the GCS using the relative browser command to save the order summary that appears in the last screen of the purchase process, or waiting to receive the automatic order confirmation message that Doria 1905 sends by email following the completion of the order. This confirmation message includes the details of the order and the GCS of Doria 1905, and can easily be printed or saved using the functions made available by the e-mail programs.

12. Applicable law

12.1 These GCS and the purchase and sale contracts are governed by Italian law (and in particular by the Consumer Code - which in Articles 46 to 67 governs distance contracts - and by Legislative Decree 70 of 09/04/2003 on e-commerce) and in the light of this must be interpreted.

12.2 For any dispute that may arise in connection with the GCS and / or sales contracts, customers can activate an out-of-court dispute resolution procedure compliant with the requirements set out in art. 141 and ss. of the Consumer Code.
